Magic Agent — Terms of Service

Welcome to Magic Agent. By creating an account or using the app, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the app.

1. Eligibility

You must be at least 18 years old to use Magic Agent. By using the app, you represent that you meet this requirement.

2. Account & Security

• You are responsible for keeping your login credentials and OTP codes secure.
• You must provide accurate information during sign-up.
• You are responsible for all activity under your account.
• Notify us immediately if you suspect unauthorised access.

3. Invite-Only Access

Magic Agent is currently invite-only. Each user receives a limited number of invite codes. Selling, trading, or publicly distributing invite codes is not permitted.

4. AI-Powered Features

• Magic Agent uses the Google Gemini API to process your messages and documents.
• AI-generated responses may not always be accurate. You should verify important information independently.
• We do not guarantee the accuracy, completeness, or reliability of AI outputs.
• Do not rely on the AI agent for medical, legal, or financial advice without consulting a qualified professional.

5. Document Storage

• Documents you upload are stored securely on encrypted cloud infrastructure (AWS S3).
• You retain ownership of all documents you upload.
• You grant us a limited licence to store, process, and display your documents within the app.
• You may delete your documents at any time. Deleting your account removes all stored documents permanently.

6. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose.
• Upload malicious files, malware, or content that violates others' rights.
• Attempt to gain unauthorised access to our systems or other users' data.
• Use the app to harass, abuse, or harm others.
• Reverse-engineer, decompile, or attempt to extract the source code of the app.

7. WhatsApp & Communication Features

Magic Agent offers optional WhatsApp integration. If you choose to connect your WhatsApp account:

• The agent will only interact with businesses, and only when you explicitly ask it to.
• Your WhatsApp authentication credentials are stored securely using encryption and are only accessed programmatically by the app. No human ever sees or has access to your WhatsApp data.
• You can disconnect your WhatsApp account at any time from the app settings.

8. Intellectual Property

The Magic Agent app, its design, branding, and code are the property of the app's creators. You may not copy, modify, or distribute any part of the app without permission.

9. Disclaimer of Warranties

Magic Agent is provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of data, revenue, or profits.

11. Termination

We may suspend or terminate your access at any time if you violate these Terms. You may delete your account at any time from the Me tab in the app.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
